Heard Mr. M. Hemchandra, learned Senior counsel appearing
for the petitioner.
The instant writ petition is the third round of litigation. In the
earlier writ petition being WP(C) No. 46 of 2019, this Court passed an
order dated 04-02-2019 directing that the respondents therein should not
fill up 4(four) posts of District Programme Coordinator till the next
returnable date which according to the petitioner, had been expended
and is in operation. Mr. M. Hemchandra, learned Senior counsel
appearing for the petitioner submits that despite the said order being
passed by this Court, the respondents issued a notification dated 31-01-
2020 completely violating the said order to which it has been submitted
by Mr. Lenin Hijam, learned Addl. AG that the petitioners were appointed
on contract basis and they had no right to continue in service in view of
the undertaking given by them that they were not entitled to continue
holding the post and accordingly, the impugned notification had been
issued.
Be that as it may, let notice be issued to the respondents
returnable on 25-01-2022.
Mr. Lenin Hijam, learned Addl. AG accepts notice on behalf of
the respondents and hence, no formal notice is called for.

By way of interim measure, it is directed that respondents may
go ahead with the said notification but 3(three) post of District Programme
Coordinator shall not be filled up without the leave of the Court.
List the matter on 25-01-2022.
